EVER WONDER WHO HOLDS YOUR MORTGAGE?
The Helping Familes Save Their Homes Act of 2009 amended the Truth in Lending Act and now requires that mortgage servicers respond to customer requests for the identity of their mortgage holder.

To benefit from the Act, the customer makes a written request to the mortgage servicer (where the monthly statement comes from) by certified mail, return receipt requested. Within a reasonable time from receipt (from 5 to 30 days) the servicer is to provide a written response that includes the name, address and phone number of the owner of the mortgage or the master servicer thereof.

If no response is provided, the customer can sue for actual damages, statutory damages, costs and attorney's fees.
